an excerpt from one of my first comments on livejournal 'way back' in 2002 ...

OK, the way we (meaning the way Common Law countries like Australia, USA, Canada, UK) run criminal trials, each team gets to have a go at scoring points with the jury.

There are rules, each team is supposed to know the rules - thats what those years spent at law school are about. The judge is the umpire. The jury gets to decide, by voting and stuff, which team they think has won the game. The judge keeps tabs on the number of fouls each team makes.

Some fouls are more serious than others - some are so bad the rules declare them a kind of cheating - they make the jury think you've scored points when you actually haven't - they prejudice the other team's scoring opportunities.

If none of that made sense, perhaps I could show you how it reads in lawyer's lingo :)
